Event Liability Waiver

    As a Civil War reenactor, taking part in the event known as the Sunbury, Ohio Civil War Reenactment and Living History Pageant, May 20,21,22, 2011, I have read and fully understand that: 

  1)   There is an inherent risk in the hobby of reenacting and that there is a risk of the loss of limbs and life itself if done incorrectly or as a result of unforeseen phenomena.

  2)   That I will at all times use discretion and reasonable caution in performing my duties as a reenactor in a safe manner.

  3)   That I am accountable for any and all of my actions during the event, both on the field and within the camp setting for the duration of the event.

  4)   That the event itself, by design, provides no unusual or extraordinary risk to my health or well being.

  5)   That The Village of Sunbury, the Gen. Rosecrans’ Department of the Ohio Headquarters, and The Big Walnut Area Historical Society, provides no unusual or extraordinary risk to my health or well being.

  6)   And that I release The Village of Sunbury,  the Gen. Rosecrans’ Department of the Ohio Headquarters, and The Big Walnut Area Historical Society, its employees and volunteers from liability resulting from any unusual or extraordinary occurrence and/ or the individual negligence of another reenactor, spectator, or other participant in the event.

  7)   If, despite this agreement, I do sue a released person, I agree to pay all costs and expenses (including actual attorney fees) incurred by the released person in defending the suit.

  8)   I do not release from liability, nor do I promise not to sue, a person who harms my property or me, intending that harm, or with actual knowledge that the specific harm was certain to result.

  9)   If a person other than myself (for example, my spouse, child, relatives, or a person who was not released under paragraph 8) institutes a claim against a released person arising out of harm to my property, or me, I promise to pay whatever amounts (including damages, costs, and actual attorney fees) the released person incurs because of this claim.

10)   I do hereby unconditionally waive all rights to the production and reproduction of my image in any medium whatsoever while in attendance of sponsored events and do hereby waive all rights to compensation of same.  This shall include, but is not limited to, my image on still photography, film, videocassette, DVD, broadcast video, audio tape, and any other current or future technology capable of capturing and or reproducing said visual or studio image.

11)   If any part of this document is found unenforceable, I agree to be bound by the remaining parts.

12)   I recognize that my participation is voluntary.  I have read the published rules and regulations and fully understand their meaning and significance.  I hereby agree to abide by the rules and regulations and to cooperate with event hosts. I acknowledge that violation of the events rules will result in expulsion from the event and its functions without recourse.

    I THEREFORE BEING OF LEGAL AGE (OR HAVE THE SIGNATURE OF A PARENT OR GUARDIAN) RELEASE AND DISCHARGE  THE VILLAGE OF SUNBURY, THE GEN. ROSECRANS’ DEPARTMENT OF THE OHIO HEADQUARTERS, THE BIG WALNUT AREA HISTORICAL SOCIETY, AND OTHERS CONNECTED THEREIN, FROM ALL CLAIMS BY REASON OF ANY CAUSE ARISING OUT OF / OR INCIDENT TO PARTICIPATING IN THIS EVENT.
